Your use of the site, the Service and the content is subject to the conditions below. If you find these Conditions unacceptable, we request that you leave the site.

All information contained in our service is presented for information purposes only. The material is in no way intended to replace professional medical care or attention by a qualified practitioner.

The materials on Diagnosia cannot and should not be used as a basis for diagnosis or choice of treatment. Limitation of liability

To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from Diagnosia’s negligence, Diagnosia hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Service, and any information, content, advertisements or products provided or distributed through the Service including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to Diagnosia. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. If you are a consumer your statutory rights, if any, are not affected.

Exclusions and Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of section 5 may not apply to you.
In particular, nothing in these Conditions shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of Diagnosia.

Proprietary Rights

You acknowledge and agree that the Service and any information presented to you through the Service contains proprietary information that is protected by protected by copyrights, trademarks, service marks or other proprietary rights and laws, applicable intellectual property and other laws. Except as expressly authorized by Diagnosia, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service in whole or in part.

Trademarks

"Diagnosia" and the Diagnosia logo are trademarks and all other trademarks used on the website and/or service marks and trade names of Diagnosia are the property of their respective owners. The website and the services contain proprietary content (including graphic design,source codes, user content and collections of personal data), trademarks and other intellectual property of Diagnosia (just the "intellectual property"). With the exception of information, which is publicly obtained or for which you have given Diagnosia the right to use (as specified below, and for which you are entitled to grant a right of use) or for which you have received from Diagnosia management a written permission, you may use the intellectual property not copy, modify, publish, transmit,distribute, publicly perform, display, reverse engineer, sell, create derivative works, or use content in different means. You may make no attempt to find out source codes used in connection with the website and / or the services. By your consent to these terms Diagnosia will allow you a limited, non-transferable, revocable, and nonexclusive right to use the interface of this website and the services and content posted there on (excluding any source code) for your personal. General information

These Conditions (including the guides and rules referred to herein) constitute the entire agreement between you and Diagnosia and govern your use of the Service, superseding any prior agreements between you and Diagnosia. The Conditions and the relationship between you and Diagnosia shall be governed by the laws of Austria. You and Diagnosia agree to submit to the non-exclusive jurisdiction of the Austrian courts. Any failure by Diagnosia to exercise or enforce any right or provision of the Conditions shall not constitute a waiver of such right or provision. If any provision of the Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Conditions remain in full force and effect.
